Oakdale Woman Killed in SR-120 Motorcycle Crash

A woman from Oakdale was killed in a crash while riding her motorcycle on SR-120 on the night of Wednesday, August 11, 2021. The fatal motorcycle accident occurred on State Route 120 near Valley Home Road just north of the Oakdale area shortly before 10:00 p.m.

Details on the SR-120 Motorcycle Crash That Claimed the Life of an Oakdale Woman

According to the California Highway Patrol (CHP), a 65-year-old Jamestown woman was driving a Toyota Prius eastbound on Highway 120. The Toyota was traveling behind a pickup truck towing a trailer. At the same time, a woman was riding her Kawasaki Vulcan west on State Route 120.

CHP traffic officers reported that the Toyota driver attempted to overtake the pickup truck by entering the oncoming traffic lane. While doing so, the Toyota collided head-on with the Kawasaki motorcycle. The impact of the head-on collision caused the Toyota to veer out of control and overturn while the motorcycle rider was propelled off their bike.

The Toyota driver was uninjured in the traffic collision, officials reported. The woman riding the motorcycle suffered serious injuries. Sadly, she succumbed to her injuries at the accident scene. The Stanislaus County Coroner’s Office has recently identified her as 61-year-old Lois Sipe of Oakdale.

Can a Family Bring a Wrongful Death Claim for a Fatal Motorcycle Accident?

The loss of a loved one is devastating, especially when it was sudden and occurred as a result of a motorcycle accident. Individuals and entities may be held accountable if their actions have resulted in a loss of life and damages for surviving family members. While compensation from a wrongful death claim may not undo the sorrow and grief that may come with a tragic loss, it may help surviving family members move forward with their lives, knowing the at-fault party has been held liable for their loss.

A wrongful death claim in California may be brought by a surviving spouse, domestic partner, or child. If such parties are non-existent, other members of the family may file. Under the California Code of Civil Procedure Section 377.60, this may include the decedent’s putative spouse, stepchildren, and parents. When legal counsel is retained, the attorney handling the case will conduct an independent investigation of the fatal incident, gather and preserve evidence, and build a strong case for fair compensation on behalf of survivors.

When seeking financial compensation, evidence in the case must demonstrate that the other party owed a duty of care to the deceased, the other individual or entity breached that duty of care, a loved one succumbed to their injuries as a result of the at-fault party’s actions, and surviving family members suffered damages because of the other individual’s negligence. Such cases must be filed within two years of the fatal accident date, under the California Code of Civil Procedure Section 335.1. The court may dismiss any wrongful death claim that is filed after the statute of limitations has expired. That is why it is essential to retain legal counsel right away. A lawyer will work to ensure all filing criteria and deadlines are met. For details on how to find the best attorney, watch this video.
