North Highlands Hit and Run Accident

A hit and run accident with injuries occurred at the Madison Avenue and Hillsdale Boulevard intersection in North Highlands at 9:50 in the morning on July 11. A gray Nissan SUV was left blocking the right-hand lane of the intersection. The fleeing driver fled the scene in a Lamborghini Diablo SV. He was apprehended at 10:16 am. After a search of the Lamborghini concluded, the California Highway Patrol (CHP) reported that there were needles found in the vehicle. However, there is no word as to whether drugs were involved in the crash. The Lamborghini sustained damage to its rear and front end. Authorities speculated that the Lamborghini was probably in another traffic accident involving property damage at the Interstate 80 offramp for Andrea Boulevard and Greenback Lane. Authorities did not report on the nature of the injuries.

What an Attorney Can Do For You

An attorney fights for your rights and helps you through a difficult time. In a hit and run accident, we use investigative techniques to help identify the person. This is important to the case. We also use our independent investigators to help determine fault in the accident. That too is a necessary element. After examining evidence procured by the investigators, reviewing police and insurance reports, and talking to witnesses, we are able to build a strong case against the defendant. It is vital that we get started as soon as possible. Many of our clients call us from the accident scene. We arrive as soon as possible to offer support and begin working on their case.

Run Away Drivers – Why Do They Flee?

Why do drivers leave the scene of the accident? There are many theories about that, ranging from fear of being caught to hiding things they would rather not be known. For instance, a driver with drugs or drug paraphernalia in their vehicle would not want the police to become aware of it. Others might lack a driver’s license or insurance and are frightened they will be cited for that. Finally, drunk drivers might want to wait until the alcohol wears off before turning themselves in. Regardless of the reason, it usually causes them to run.

How Many Hit and Run Accidents Occur

Hit and run accidents are more common than you may think. Nationwide, one hit and run accident occurs every minute. In 2016, fleeing drivers caused the deaths of 2,049 people, and 65 percent of them were bicyclists and pedestrians. In California, being found guilty of a hit and run crash can result in large fines, loss of a driver’s license, and time in prison.

How a Criminal Charge Can Help Your Case

Hit and run drivers are charged with either a misdemeanor or a felony. The former is usually used when the damage is only to property, while the latter is associated with serious injury or death. The criminal charge can be used by an injury lawyer to help your case. You don’t have to be negligent to be charged with a hit and run. You just have to leave the site of the accident.

In a criminal case, the prosecutor must prove that the hit and run driver committed a crime. In a personal injury case, the plaintiff’s lawyer (the injured party’s counsel) proves that negligence was involved and caused injuries. Yet, a criminal conviction based on evidence that proves it beyond a reasonable doubt can be used in the injury case. It establishes the evidence that the hit and run driver was operating their vehicle recklessly. Your attorney will present these facts to the jury, judge, or insurance company to obtain the damages you deserve.
