Dog Attack Against Mailman Occurs Near Roseville Road

According to the Sacramento County Sheriff’s Office, a North Highlands mailman was attacked near the Roseville Road intersection with Walerga Road recently, which caused severe injuries. The mailman was approaching a door to deliver mail when the pitbull pushed open the screen and attacked the 73-year-old. The dog’s owner and a passerby who had called 911 for help attempted to stop the attack.

Mailman Suffers Major Trauma in Dog Attack

The mailman suffered major trauma to his face, leg, arms, and hands. The dog’s owner was also injured, although the extent of trauma was not reported. The dog was surrendered to the Bradshaw Animal Shelter by its owners and is scheduled for euthanization. First responders came to the scene and treated the dog bite injuries. The mailman was transported to a hospital for additional care.

What Is the California Law on Dog Bites?

If a dog attack occurs in a public or private area, the owner is financially responsible for any injuries sustained under California law. The injured person must have either been invited to or lawfully present on the premises if the incident occurred on private property. Postmen, salesmen, and others fall into this category. The law does not cover persons who are trespassing or committing crimes, and they cannot file a claim for damages related to dog attacks.

Do I Have to File a Claim Within a Certain Period?

After suffering a dog bite injury, an individual may file a claim for compensation for up to two years from the date of the incident. If you are suing a government entity, the filing deadline is much shorter. However, contacting an experienced dog bite lawyer as soon as possible is a good idea. The lawyer can investigate the injury, investigate previous complaints, and build a strong compensation claim. By filing a personal injury claim, the injured party may recover all their medical bills, wages lost from being unable to work, and compensation for their pain and suffering.

Does It Matter That the Dog Never Attacked Anyone Before?

One-bite laws exist in some states. In other words, in these states, the owner’s dog bit someone but couldn’t be held liable unless it happened again. In California, however, strict liability applies. As a result, whether the owner knew or should have known that the dog had previously bitten someone is irrelevant.
