Folsom Accident on U.S. 50 Causes Death of Driver

A motorist was killed in a Folsom accident on July 30 after their vehicle spun out and went down an embankment. According to authorities with the California Highway Patrol (CHP), the crash involved the driver of a minivan. The accident happened along westbound U.S. 50 just west of the northbound Prairie City Road on-ramp around 8:23 p.m.

Folsom Accident Motorist Allegedly Reckless Driving

It was reported that the driver behaved recklessly before the crash happened and crashed into multiple vehicles, although it was not stated whether this occurred before or during the accident. Authorities discovered the minivan, a Honda Odyssey, with major damage along the right-hand side of the roadway. Although the driver was transported to UC Davis Medical Center, they died from their trauma. Investigators with the CHP traffic collision division are determining what happened.

Fatalities When a Driver Loses Control

A driver can lose control of their vehicle for many reasons and crash in a Folsom accident. Most of these collisions are the fault of the driver, such as speeding, being distracted, or other errors. However, a smaller percentage occurs due to an outside influence as follows:

  • Neglected road repairs: A government entity may be held responsible for a fatality caused by poor roadway maintenance if it neglects its responsibilities. Potholes, malfunctioning traffic signals, or inadequate nighttime lighting can all result in a driver losing control of their vehicle. There is also a much shorter statute of limitations for claims against government entities than for claims against other individuals or entities. A claim for compensation from the government must be filed within six months of the incident. A lawyer can help you ensure that all of your paperwork is filed on time as soon as possible.
  • Mechanical failure and faulty auto parts: Manufacturers are responsible for accidents caused by defective auto parts. Brakes that fail, an accelerator that sticks or other problems can cause a serious Folsom accident. Retaining a vehicle will allow you to detect defects. There is the possibility of filing lawsuits against manufacturers for product liability if a defect is found.
  • Fleeing drivers: The driver of a hit-and-run may appear to have been involved in an accident due to the fact that the other motorist fled the scene. An injury lawyer can identify the at-fault driver by investigating an accident and determining if another motorist committed a hit-and-run.

Lawsuits Involving Wrongful Death

Many of our clients have suffered wrongful death as a result of the demise of a loved one. Families often overlook the possibility of filing a wrongful death claim when a loved one dies due to their grief. However, they soon realize their financial situation is affected by their loss.

In addition to compensation for the decedent’s surviving spouse and children, wrongful death claims may be able to seek compensation for burial and funeral expenses and the decedent’s wages until retirement age. They will not be able to ease their grief with financial compensation, but they are better prepared for the future financially.
