What is Wrongful Death?
Wrongful death in California is defined as a life that was cut short due to the negligence or carelessness of another individual or entity. The legal process provides an opportunity for surviving family members to seek justice and compensation for the unexpected losses associated with the sudden death of their loved one. An attorney with years of experience handling wrongful death cases arising from motorcycle accidents can offer services to support surviving family members dealing with such situations, including:
- Conduct an in-depth investigation into the incident to identify all liable parties and all sources of financial recovery to compensate survivors
- Gather and preserve evidence in support of the claim to identify potentially liable parties involved in the accident, establish the opposing party’s negligence, and the extent of the resulting damages
- Handle negotiations with insurers to reach a mutual agreement to resolve the matter
- File a case in court within the applicable deadline to ensure that the statute of limitations is protected
- Consult with expert witnesses, if necessary, who can provide specialized opinions and insights into the different aspects of the accident
- Litigate the matter, including consulting with expert witnesses on behalf of the client, preparing exhibits, opening arguments, closing arguments, and more
