Wrongful Death Claims After Fatality Accidents

For families grieving the loss of a loved one after a motorcycle accident resulting in death, our personal injury lawyers know how to obtain fair compensation for their loss. To help your family receive maximum compensation, we investigate the fatal collision so that evidence can be collected to support their claim and calculate the damages they are likely to receive. We work hard to obtain the most favorable outcome by negotiating with the insurance company on your behalf. The evidence gathered for your claim can be used in a civil court if the insurance company refuses to pay what your family should receive.

The Requirements for Filing a Wrongful Death Claim

An individual’s immediate family is the first in line to file for wrongful death. Biological or adopted children are included. If a decedent’s dead offspring has children, they may join the lawsuit. The estate administrator may file instead, but only one claim is possible. The parents and siblings of the deceased may file a claim if there are no immediate family members.

Recoverable Wrongful Death Damages

Damages recoverable following a motorcycle crash resulting in death are influenced by a number of factors, including the decedent’s education and age. It is possible, however, for the family to recover damages in the following areas:

  • Expenses associated with the funeral and burial of the deceased
  • The family may also collect any benefits the deceased received during his or her working career in addition to the deceased’s wages
  • A spouse can recover compensation for their lost love, affection, and consortium
  • Children in the family can recover loss of nurturing and guidance
  • Loss of household assistance may be claimed
