Things to Know About Motorcycle Accident Injury Cases

A motorcycle crash may be one of the most life-changing events to ever happen to a motorcyclist and their family. That is because these collisions have the potential to result in some of the most severe injuries on the spectrum, from road rash and bone fractures to traumatic brain injuries and spinal cord injuries. Sadly, motorcycle accidents happen all too often in California and are often caused by the negligence of motor vehicle drivers. Damages to an injured party may come with a significant price as there may be mounting medical expenses, wage loss, and other losses. Fortunately, an injured party may file a bodily injury claim against the other side and their insurer for reimbursement of economic and non-economic damages.

It is crucial for parties injured in motorcycle crashes to know that they do not have an unlimited amount of time to bring a case. The California Code of Civil Procedure Section 335.1 states that there is a two-year statute of limitations applicable to injury cases. When an insurance settlement has not yet been accepted, and a lawsuit has not yet been filed in civil court within the two-year anniversary of the incident, the injured party may lose the right to seek financial compensation from the at-fault party. Remember that different deadlines also apply to insurance claims. For instance, an insurance company must be notified of an accident within a specific period. This varies in the contractual language of the policy from insurer to insurer. Failing to follow these may result in a dismissal of the insurance claim.

Working with an experienced Brentwood motorcycle accident attorney is essential not only for the outcome of your case but also to have the time to recover from the incident. That is because there is substantial time and effort that comes with building these cases, from independent investigations to working with experts in the field. This may be necessary even in those cases where liability is clear. Insurance companies and at-fault parties may dispute fault for the crash and make the recovery process challenging for injured motorcyclists. Fortunately, an accident attorney will be there to protect the rights and best interests of their client throughout the process.
