Motorcycle Accident in San Mateo Kills One, Injures Two

Fatal Motorcycle Accident Occurs on State Route 92

One person died, and two others were seriously injured in a motorcycle accident on September 20 on State Route 92 in San Mateo. The California Highway Patrol (CHP) reported that the crash occurred on the westbound lanes of the highway at about 10:00 in the morning.

The CHP said that a BMW was disabled in the number two lane. A group of motorcyclists in the slow lane swerved to avoid hitting the vehicle. Two motorcyclists were unable to avoid hitting the vehicle.

Further Details of the Motorcycle Crash

The rider of one of the motorcycles was thrown into the San Francisco Bay by the force of the accident impact. The motorcyclist has since been identified as Kyle Davis, 34, a resident of Sacramento, by the coroner’s office in San Mateo. According to reports at the scene, the rescuers from the United States Coast Guard retrieved Davis’ body from the water.

The other motorcyclist and a passenger collided with the BMW. They suffered major injuries in the motorcycle accident and were transported to Stanford Medical Center for treatment. There is no further word on their condition at this time.

The driver and an occupant of the BMW were said to have walked west on the bridge, abandoning their vehicle. The CHP is actively investigating the motorcycle accident to determine how and why it happened and who was at fault.

Losing a Loved One in a Motorcycle Accident

The sudden loss of a loved one is something many families face. The grief and anger family members feel is compounded if the loss is due to another’s negligence. In addition to the emotional turmoil, some families are also caught in a harrowing financial crisis. This is where a wrongful death lawyer can help. At our firm, we provide compassionate service to families as we help them obtain the compensation they need.

What Is a Wrongful Death Lawsuit

A wrongful death lawsuit is a way for a family to satisfy the financial harm they have been dealt by their loved one’s demise. This is especially true if the decedent was the main provider of household monetary support. A wrongful death attorney can provide the assistance the family needs to file and successfully resolve this claim.

The following video presented by attorney Ed Smith will help you understand a wrongful death lawsuit:

Who Can File a Wrongful Death Lawsuit

The following surviving family members are able to file a wrongful death claim:

  • The spouse of the decedent
  • The putative spouse of the decedent (In California, someone who believes they are married to another person without knowing that individual is already married)
  • Children of the decedent
  • Stepchildren of the deceased
  • Children of the putative spouse
  • Minors who receive half of their support from the decedent and live in the deceased’s home for a minimum of 180 days
  • Parents and siblings if they are supported by the decedent

How to Help a Grieving Family

There are many things to do that will support a grieving family:

  • Let them know you are thinking about them with a call or in person.
  • Offer to run errands such as picking up prescriptions, taking them to the doctor, or going to the grocery store for them.
  • Drop off pre-made meals.
  • Offer to accompany the family to the funeral parlor to make arrangements.
  • Let them know that you will be there for them after the funeral is over.

Road Hazards

It is illegal to abandon a vehicle along the highway in California. The law also says that no one can abandon their vehicle on either a public or private property without permission. If the police find the vehicle and determine it is a hazard to other motorists, they have the right to tow it within four hours. The vehicle’s driver should make an effort to alert other drivers that the vehicle has broken down to avoid unnecessary collisions.

Investigating a Motorcycle Accident in San Mateo

Motorcyclists are especially vulnerable due to their small stature on the road. Our firm sends investigators to the accident scene to determine liability. We interview witnesses and obtain video that shows the accident as it happened from a variety of sources. Our investigators also use accident reconstruction to determine liability.

Once the evidence has been gathered, our investigators pass it on to our lawyers. The data they receive is used to build a strong case for our client.
