Is There a Time Limit to File a Wrongful Death Claim?

In California, a family member of the decedent has two years from the date of a wrongful death truck accident to file a claim. This is by the California Code of Civil Procedure Section 335.1. If a case is not filed within the deadline, it will likely be dismissed by the court. This is why it is essential to meet with a wrongful death lawyer in Modesto as soon as possible. An attorney can review the details of your case and provide you with some potential options for recovery.

Why Do We Need a Lawyer?

Insurance companies representing truckers and their employers often try to take advantage of a family’s vulnerable situation by offering low-ball amounts for their wrongful death cases. Such settlement offers do not take into account the full value of a loved one’s life. Only an experienced Modesto wrongful death lawyer knows how much your loved one meant to you and will ensure you will not settle for less than what you and your family deserve.
