Revlon Lawsuit Targets Use Of the Company’s Talc Powder

On February 25, 2020, a lawsuit was filed against Revlon Inc., alleging that a woman was stricken with mesothelioma cancer because of asbestos in the company’s cosmetic products. The lawsuit was filed in state court in New York by a couple from Maryland. It was filed by Laura McDaniel, who was diagnosed with mesothelioma in January as well as her husband. Her father had been employed by Revlon in New York City for many years. McDaniel believes her cancer stemmed from there because her father would bring company products home for her to use. This included Jean Nate Silkening Body Powder, which had been sold by Revlon since 1935. Revlon is a multinational company that makes cosmetics, fragrances, and skincare products.

Mesothelioma Lawsuits

Most of the over 16,000 lawsuits pending in U.S. courts are by women who have been diagnosed with ovarian cancer, which they believe was caused by products containing talc that was contaminated with asbestos. McDaniel is seeking a judgment of $20 million, along with an additional $40 million punitive damages. Her husband, Edward McDaniel, has filed a lawsuit also for $5 million because of loss of companionship and mental anguish.

Incidence of Mesothelioma

Mesothelioma is diagnosed in the United States in about 3,000 patients each year, many cases due to occupational exposure. A much smaller number of cases involve cosmetic products. Mesothelioma cancer is aggressive and rare and usually occurs from the ingestion or inhalation of asbestos fibers. In the case of cosmetic use, it is caused by talcum powders that are contaminated. Johnson & Johnson Inc has almost 16,000 cases pending in court because of the allegation that their popular baby powder caused cancer in women.

Asbestos Still Found in Talcum Powder Products

One of the problems is that both talc and asbestos are found near each other. However, talc that is cosmetic grade is not strictly regulated, although the U.S. Food and Drug Administration stresses being selective when choosing mining sites and purifying the talc, so asbestos contamination does not occur.
