Man Killed in Central Fresno Pedestrian Accident

Man Killed in Pedestrian Accident Near Central Fresno

A man was killed in a recent pedestrian accident near central Fresno. The crash occurred shortly after 1:30 a.m. along northbound Highway 99 just south of Clinton Avenue. According to the California Highway Patrol (CHP), a man and a woman, identified as a husband and wife, were initially involved in a single-vehicle accident. The couple was standing outside of their 2014 Subaru on the right shoulder of the freeway awaiting assistance. At the same time, a 22-year-old Madera man was driving a 2007 Honda Civic approaching the scene of the initial crash. As the Honda driver approached the man and woman standing on the right shoulder of the road, he reportedly made an unsafe turning movement to the right and collided with the concrete wall. This caused the Honda to veer out of control and crash into the couple, as well as their Subaru. The wife was transported to a hospital in Fresno for treatment of major injuries. Sadly, her husband succumbed to his injuries at the scene. Officials have identified him as 28-year-old Joshua Eisen of Merced. A GoFundMe page has been established on behalf of Mr. Eisen and his wife to help cover his funeral expenses and her medical bills.

Loss of a Loved One in a Central Fresno Pedestrian Accident

The loss of a loved one in a pedestrian accident is devastating, especially when the incident was caused by the negligence of someone else. Knowing what to do next is undoubtedly challenging when dealing with grief and unexpected expenses. Chances are contacting a wrongful death lawyer may be the last thing on your mind. However, it is often the best way to ensure that you and your family are taken care of in your time of loss and grief.

Types of Wrongful Death Damages

When a family is suffering the tragic loss of a loved one due to a pedestrian accident, a wrongful death claim may help. These types of cases are intended to seek compensation from the negligent driver’s insurance company for the intangible and financial losses related to a loved one’s wrongful death. These include:

  • Any expenses associated with a loved one’s funeral and burial
  • Emotional suffering due to the wrongful death car accident
  • Loss of affection, love, companionship, protection, and moral support to the survivors
  • Loss of future financial support and benefits, including retirement, pension, or health insurance
  • Medical expenses for treating the injury the decedent suffered before he or she passed away
  • Punitive damages may be sought from a negligent driver for egregious misconduct, such as excessive speeding or drunk driving (this type of damage is intended to punish the at-fault party for their negligence and discourage similar behavior in the future)

The below video includes a brief overview of wrongful death cases and what damages may be claimed by surviving family members.

Can Anyone File a Wrongful Death Claim?

Specific relatives are entitled to wrongful death damages under the California Code of Civil Procedure Section 377.60. This includes the surviving spouse, domestic partner, or children of the deceased. Others may be eligible to file for wrongful death, such as the decedent’s putative spouse, stepchildren, parents, or children of the putative spouse. This is dependent upon the individual circumstances of the case. To determine whether you meet the eligibility requirements for a wrongful death case, contact an experienced wrongful death lawyer in Fresno for assistance.
