Man Killed After Hit and Run in Central Fresno

A man was killed after a hit and run accident that occurred recently in central Fresno. The incident occurred shortly before 10:30 p.m. on Blackstone Avenue near Belmont Avenue. When officers from the Fresno Police Department (Fresno PD) arrived on site, they found that the suspect vehicle had fled the scene and authorities were not able to locate any witnesses who saw the pedestrian accident. Sadly, the man who was involved in the hit and run accident was pronounced deceased at the scene. Officials have identified the decedent as 54-year-old Rosendo Hernandez of Fresno.

Loss of a Loved One to Wrongful Death

The loss of a loved one often changes the lives of the family members left behind. Not only do they lose that person’s presence and companionship, but they also lose the contribution they made to the family. This includes the primary provider’s financial support, a spouse who took care of maintenance or chores around the house, or a son or daughter who provided care for an elderly parent. While filing a wrongful death action to seek compensation may not bring a loved one back, it can provide a family with the solace and financial relief they need to replace those services and tasks in their life. A Fresno wrongful death lawyer can handle the legal complexities of these cases on a family’s behalf so they can focus on recovering and grieving from their loss while justice and fair compensation are obtained on their behalf.

Types of Recoverable Damages in a Wrongful Death Case

A Fresno pedestrian accident attorney can seek full compensation for damages in fatal pedestrian accidents, including costs in the future. Depending on the circumstances of a wrongful death case, an attorney may demand payments for:

  • Costs of end of life medical care the deceased received before they passed away
  • Expenses for a funeral and burial after a fatal pedestrian accident
  • Loss of protection, companionship, and affection
  • Lost income, employment benefits, and future earnings for the family who depended on the decedent as the primary provider of the household
  • Lost parental companionship, training, and guidance for surviving children
  • Punitive damages are available in specific cases where a loved one’s wrongful death was the result of egregious conduct (these damages are designed to punish the at-fault party and to deter others from behaving in the same way in the future)

Who Can File a Wrongful Death Claim for a Fatal Hit and Run in Central Fresno?

Specific surviving family members must file a wrongful death lawsuit within California’s two-year statute of limitations. This means a claim must be filed within two years of a loved one’s wrongful death, or it will be dismissed by the court if it is not filed by the deadline. Survivors who are entitled to wrongful death damages include the surviving spouse, domestic partner, or child of the deceased. This is by the California Code of Civil Procedure Section 377.60. Others may be eligible to file, including the putative spouse, stepchildren, and parents of the decedent. Does a Lawyer Really Help in the Outcome of a Wrongful Death Case?

While seeking damages through a wrongful death claim, you are not guaranteed what an insurer will offer. The insurance company representing the at-fault party may offer a low-ball settlement. In hit and run accident cases, the decedent’s or surviving family member’s insurer may do the same for an uninsured/underinsured motorist claim, if the negligent driver is not found. This is their way of protecting their bottom line. At AutoAccident.com, our Fresno pedestrian accident lawyers have a family’s best interests in mind and work diligently to recover the full and fair compensation to which they are entitled to the wrongful death of their loved one. We will collect evidence on behalf of survivors to help prove their wrongful death claim, communicate with insurance companies throughout the negotiations process, or take the case to court, if necessary.
