Major Vehicle Accident Near Willow Creek Occurs on S.R. 299
A major vehicle accident occurred on State Route 299, west of Willow Creek and northeast of Eureka, on July 14. The accident resulted in multiple injuries and sent multiple individuals to the hospital. Among the injured were four children, including one with a broken leg and another with a fractured spine. The father sustained critical injuries, requiring several surgeries, and remains in the ICU. He is expected to face an extended recovery period and will be away from work for some time.
Caltrans Vehicle Involved in Major Vehicle Acccident
The Humboldt Area California Highway Patrol (CHP) reported that the incident took place shortly after 6:00 p.m. when the driver of a Caltrans SUV seemingly lost control of the vehicle, crossing the median and colliding with oncoming traffic. The Caltrans employee, who was traveling at the time of the accident, sustained minor injuries.
According to a spokesperson for the CHP, it appears that the Caltrans worker may have fallen asleep at the wheel, drifted into the oncoming lane, and caused the collision.
Multiple Patients Hospitalized Following Major Vehicle Accident
The injured were transported by ambulance to Providence St. Joseph and Mad River hospitals, based on the severity of their injuries and the availability of hospital resources. Emergency responders arrived at the scene, and S.R. 299 remained partially closed until 9:00 p.m. while the injured were assisted, CHP officers conducted their investigation, and crews worked to clear the wreckage. To support the family during this challenging time, a GoFundMe page has been created to help cover expenses and provide much-needed assistance.
Liability in Accidents Caused by a Caltrans Employee Who Fell Asleep at the Wheel
Accidents involving government employees, such as those caused by a Caltrans employee falling asleep at the wheel, often require examining whether the employee was acting within the scope of their official duties at the time of the incident. If the employee was performing their job responsibilities, the government entity, such as Caltrans, may be held liable under the principle of vicarious liability. However, if the employee was engaging in personal activities outside of their work duties, they may be personally liable for the accident.
Filing a Claim Within the Statute of Limitations
The statute of limitations governs the timeframe within which an injured party must file their government claim. In California, the time limit is six months. Failing to file within the designated time can result in the dismissal of the case, forgoing any opportunity to recover damages. Timely action and legal guidance are essential to protect the claimant’s rights and achieve a successful resolution.
