Major Injuries Reported in Merced County Rollover Accident

Major Injuries Reported in Merced County Rollover Accident

I’m Ed Smith, a Merced car accident lawyer. A rollover accident in Merced County left the driver and a passenger with major injuries on August 16, 2018. At approximately 3:40 in the afternoon, a 34-year-old man was driving his F-150 pickup truck northbound along Highway 99 in the vicinity of Le Grand Road. For unknown reasons, the Ford veered off of the roadway and overturned several times. The impact of the collision reportedly ejected the driver and a 27-year-old female passenger out of the truck, causing both parties to suffer serious injuries at the scene. An air ambulance was called to the scene to transport both victims to area hospitals for immediate treatment. An update on the conditions of the victims involved in the crash has not yet been released by officials.

How to Avoid a Rollover Accident

Understanding the ways of reducing your chances of being injured in a rollover accident is key. Follow these tips:

  • Always wear your seat belt as this can reduce your chances of being ejected out of your vehicle in the event of a rollover
  • Drive defensively
  • Inspect your tires regularly and ensure they are balanced and in good condition
  • Never drink and drive as this can significantly impair your ability to operate a motor vehicle safely
  • Reduce your speed when inclement weather or congested traffic conditions are present
  • Take turns at slower speeds as traveling at high speeds around a bend can cause your vehicle to lose traction and overturn

Rollover Accidents and Crushed Roof Injury

The odds of avoiding a severe injury or wrongful death in a rollover accident depends on the strength of the vehicle’s roof. If a roof does not provide adequate protection in the event of such crashes, spinal cord injury, internal trauma, traumatic brain injury, and even death may occur as a result. Since manufacturers are legally obligated to design and manufacturer cars that provide occupants with reasonable safety to prevent foreseeable harm, these entities may be held financially responsible for damages caused by defective vehicle roofs. Car Accidents and Passenger Injury Claims

When a passenger is involved in an accident with another vehicle, the first step in figuring out who will cover your damages is by determining who was at fault in the crash. If the motorist of the vehicle the passenger was riding in was proven to be at fault, then the passenger would seek recourse by filing a claim against the insurance policy of that driver. If the driver of the other vehicle was found at fault, then the passenger would seek compensation from the insurance carrier of that motorist. When a traffic accident is caused by a driver with limited insurance policy limits or no insurance at all, then a passenger may be able to bring a claim against their own automobile insurance policy if they have Uninsured/Under-Insured Motorist Protection.
