What is a Wrongful Death Case and How Does it Help Survivors?

Wrongful death refers to the loss of a loved one in an accident caused by the negligent actions of another party or entity. When this happens, it is often the family of the decedent that is left behind to figure out how to pick up the pieces. Fortunately, California law recognizes this and provides a way for survivors to take legal action against the party responsible for their loss through a wrongful death claim. Financial compensation is generally sought in the form of a case brought against the at-fault party and their insurance company. In situations where there is insufficient or no liability coverage, surviving family members may have a different avenue of recovery through uninsured and underinsured motorist coverage.

Keep in mind that civil cases are subject to strict filing deadlines in California. Survivors usually have two years from the date of the fatal car accident to file a lawsuit. This must be done if an insurance settlement is not accepted within that time. Failing to file to protect the statute of limitations may result in the dismissal of the case by the court. This ultimately results in the loss of the right to take legal action and seek compensatory damages. Since many factors are involved in the process, it is essential to work with an accident attorney with experience in wrongful death matters. Importance of Discussing Your Case with an Attorney

Reaching out to a lawyer is probably not the first thing that surviving family members would want to do after losing someone they love. However, survivors should consider discussing their case in detail in a free consultation with a skilled Madera wrongful death lawyer immediately. As mentioned previously, a two-year statute of limitations generally applies to these cases in California. While this may seem like ample time, it may take several months for an independent investigation of the incident, identification of all at-fault parties, and potential sources of recovery. Remember that any delay in seeking legal representation may result in the loss of evidence that is essential to proving the case.
