Following a Wrongful Death

Families don’t always consider a loved one’s safety when that person walks out the door. They simply assume they will see their loved one later, and they usually do. However, there are times when an act of negligence by another takes their loved one away. Consumed by grief and incredulity, it doesn’t always occur to family members that they’ve not only lost someone they cherish but can even suffer the indignity of financial distress because of it.

At AutoAccident.com, we understand your confusion, grief, and sense of loss and are here to offer free and friendly advice if you would like to find out about filing a wrongful death claim. We find that many people doing so not only obtain the compensation needed for them to go on but that it offers them a sense of justice and closure.

What Can Be Recovered Through a Wrongful Death Lawsuit

A wrongful death claim is a civil lawsuit brought by close family members of the deceased person. They include the recovery of economic and non-economic damages. Compensation from a wrongful death lawsuit can include the following:

  • The cost of the funeral and burial can be recovered.
  • The loss of income the decedent would earn until their time of retirement can be claimed.
  • The loss of inheritance that results from death is recoverable.
  • Children in the family, whether natural, adopted or stepchildren who received at least half their support from the decedent, can claim loss of guidance, nurturing and care that was provided.
  • The spouse can place a claim for the loss of consortium, companionship, and emotional support the decedent provided.
  • Loss of the services the decedent provided to the family is recoverable. These are things such as mowing the lawn, servicing the car, childcare, and others.
  • Punitive damages may be claimed through filing a survivor action if the death was especially grievous or intentional. Punitive damages are frequently much higher than those for wrongful death and are in addition as punishment for the wrongdoer and to discourage others.

Family Members Who Can File

Members of the immediate family of the deceased can file a claim for wrongful death. This includes:

  • The spouse or putative spouse can file a claim.
  • Children of the spouse or putative spouse can file.
  • The grandchildren of a deceased child of the decedent can join in filing the claim.
  • Parents of the deceased are allowed to file if the decedent contributed at least half of their support.
