Accident at Bradshaw and Jackson Road in Rosemont

An intersection crash in Rosemont happened on April 4 and resulted in injuries. It was reported by the California Highway Patrol (CHP) that the accident happened around 2:00 in the afternoon at Bradshaw Road and Jackson Road in the vicinity of Walsh Station. The CHP was informed that there were injuries reported as a result of the collision, and emergency responders were called to the scene. The incident will be investigated by the CHP to determine fault and how it occurred. The condition of the injured person has not yet been announced by authorities as of the time of this report.

Reasons for an Intersection Crash

Being involved in an intersection crash is common, and most people might think injuries are minor because these collisions often occur at lower speeds. However, fatalities and severe injuries do occur. One of the big problems with intersections is that traffic is moving in multiple directions, vehicles are turning, and motorcyclists and pedestrians add into the mix. Accidents can be caused by the following reasons:

  • A driver attempts a left turn in front of oncoming traffic, causing a head-on collision or side-impact crash.
  • A motorist stops at a traffic light and is crashed into by the vehicle behind because the driver is distracted, speeding, or fatigued.
  • A motorist makes a right-hand turn when their view of oncoming traffic is blocked.
  • A driver ignores the stop sign or red light and attempts to speed through the intersection.
  • Sideswipes happen when two vehicles are turning and either get too close to each other or one tries to change lanes without looking.

Government Neglect in an Intersection Crash

Neglect in maintenance or poor design in an intersection can lead to a traffic accident. When this happens, the government entity in charge of the design and maintenance can be held financially responsible. However, there is a much shorter period of time in which to file. This makes it necessary to obtain the advice or help from an experienced lawyer to ensure paperwork is filed on time. Otherwise, the case will likely not be heard in court. Some causes of government neglect that can lead to an intersection crash include:

  • Confusing or missing signs
  • Lanes that are too narrow
  • Pooled water that contributes to braking problems or hydroplaning
  • Potholes, upheavals and broken pavement
  • Missing lane markings
  • Malfunctioning traffic lights
  • A blocked view that keeps drivers from spotting oncoming traffic
  • Debris

Evidence Needed to Prove Fault

Evidence is needed to prove fault in an accident in order for the injured person to place a claim for compensation. A thorough investigation is key in proving a claim. Our investigators do the following to help a client:

  • Investigators go to the site and interview the witnesses and review the police report to ensure that it is accurate.
  • They comb the area for traffic and business surveillance cameras that could have caught the accident on tape.
  • The investigators perform accident reconstruction. This type of evidence is commonly used by insurance companies and in court to show how an intersection crash occurred. It shows the original placement and position of the vehicles during and after the collision. Paint smears, areas of impact, pieces of metal that have fallen onto the road, tire marks and other evidence are compiled to give a complete picture.
  • The evidence is given over to our lawyers. Our lawyers use the evidence to build a case in favor of the client to recover personal injury damages.
