They were described as a black pickup truck, a white GMC Envoy, and a black Chevrolet SUV. One of the cars reportedly sustained severe front-end damage in the collision, according to the CHP. How a Car Accident Injury Claim Works

A personal injury claim is intended to make an injured person whole again after an accident and should cover every loss they have suffered as a result. This may also include future expenses if the injured party is not able to work because of the severity of their injury. Some of the common types of losses recovered after a car accident include:

  • Costs of past and future medical treatment
  • Wage loss for the time an employee misses from work to recover after a car crash
  • Loss of future earning potential for permanent injury or disability suffered as a result of the collision
  • Mental anguish due to post-traumatic stress disorder or anxiety caused by the accident
  • Loss of consortium
  • Lost enjoyment of life due to the severity of the injuries sustained
  • Pain and suffering for the physical and emotional trauma related to a car accident injury

Who Pays for Injuries and Damages After a Stockton Car Accident?

A personal injury claim is structured upon elements of negligence in California. For instance, if a driver causes an accident and injuries, they are responsible for losses resulting from their wrongdoing. Compensation may be sought from the at-fault party directly and their insurance company. As long as it can be proven through evidence that they are liable for the crash, their insurer will have to pay for resulting damages. In cases where the other driver carries state minimum coverage, an injured party may use their underinsured motorist bodily injury coverage (UIM) to supplement damages not fully paid for by the at-fault party. If the negligent driver does not have insurance, uninsured motorist bodily injury coverage (UM) may come into play. For more information about UM coverage, watch the video below.

Should I Hire a Personal Injury Lawyer for My Car Accident?

After a car accident, the other driver’s insurance company may dispute fault for the accident and losses incurred. They may offer low ball settlement offers in the claims process or even deny a personal injury case to avoid paying it out entirely. This can be stressful, especially when trying to recover from your injuries, have your vehicle repaired, and get back on your feet to return to work to support yourself and your family. At AutoAccident.com, we have the experience, dedication, and resources to handle all legal aspects of your personal injury claim while you focus on recovering and getting your life back on track.
