A South Lake Tahoe motorcycle collision on November 3 caused injuries to a female passenger. The crash did not block the roadway, according to the incident report by the California Highway Patrol (CHP)

Cal Fire emergency responders were called to assess trauma and discovered the female passenger had allegedly suffered injuries to her vision. She was transported to a hospital for additional evaluation and care. On the Harley-Davidson motorcycle, the rider and his passenger were on sustained damage and were towed from the scene. An evaluation of the cause of the motorcycle crash is underway by CHP traffic crash detectives.

Duty of Drivers Toward Their Passengers

Whether it is an accident involving a motor vehicle, motorcycle, or other type of transportation, the driver is responsible for the safety of their passengers. While some collisions are unavoidable, if the driver of the vehicle was negligent, which led to the South Lake Tahoe motorcycle collision, they may be held responsible for the losses caused by injuries suffered by their passenger.

Compensation in a Personal Injury Claim

Compensation the injured person may recover by filing a personal injury claim includes the following:

  • Medical costs caused by the South Lake Tahoe motorcycle collision are recoverable. Costs include hospitalization, physicians’ bills, medication, testing, surgeries and rehabilitation. If the injury has not been resolved and further medical care is required, those costs are factored into the settlement.
  • Unpaid wages because of your accident injury are recoverable, including the value of any bonuses you received in your job, such as insurance and pension benefits. If permanent disability occurs, wages until retirement age are included. The salary difference is included if the person has to take a lower-paying job due to their injury.
  • Pain and suffering compensation is recoverable, which includes the physical and emotional trauma you experienced.

Injury Claims Following Motorcycle Accidents

When a motorcycle crashes into another vehicle, it can cause severe injuries such as brain damage and multiple fractures. As a result, the rider may be unable to work for an extended period, which causes medical bills to pile up, as well as pain and suffering associated with an accident. Accidents caused by negligent drivers or other entities may be covered by compensation if the injured party files a claim.

Getting Compensation after a Motorcycle Accident

AutoAccident.com’s motorcycle accident lawyers can compile evidence on your behalf and negotiate with the insurance company to support your claim. A case may be taken to civil court if negotiations with the insurance company fail and they refuse to cover your losses. As a result of our years of experience handling motorcycle accidents, I even wrote a book called California Motorcycle Accident Handbook, which is available on Amazon or our website for free. A motorcycle accident injury guide answers some questions motorcycle riders commonly ask.
