Recovering Compensation by Filing a Wrongful Death Claim

The spouse and children of the deceased, who died in an accident caused by a negligent driver, might recover the following by filing a wrongful death claim:

  • The expenses for the funeral, as well as the burial or cremation, can be recovered.
  • Earnings the loved one was entitled to receive until they reached retirement age can be recovered, as well as compensation for their pension/insurance benefits and others.
  • The spouse may claim loss of the consortium between partners, affection, and the emotional support the decedent provided.
  • The children who were supported by at least half by the decedent can claim the loss of parental nurturing and guidance.
  • Household services that were lost due to the death can be compensated since the family would have to hire someone to take care of those jobs.
