Girl Injured in Brentwood Pedestrian Accident

A young girl was injured after a pedestrian accident in Brentwood on the afternoon of August 6, 2020. The injury incident occurred shortly before 2:20 p.m. at the 800 block of Second Street. Upon the arrival of East Contra Costa County Fire Protection District personnel, a young girl was found in the roadway after being struck by a car. Officials said the vehicle had damage to the windshield and hood from the pedestrian accident.

The child was transported via air ambulance to a local hospital for treatment of unspecified injuries. The cause of the auto vs. pedestrian crash is under investigation by the Brentwood Police Department (Brentwood PD).

Duty of Care Owed to Children in the Road

Drivers are responsible when operating a motor vehicle safely and watching for pedestrians or cyclists. However, California law places a higher duty of care on motorists when driving in areas where children are likely to be present. This includes neighborhoods, school zones, parks, and more. When a driver fails to do so and causes a pedestrian accident involving a child, they may be held financially liable for injuries and losses incurred.

What is the Statute of Limitations for a Brentwood Pedestrian Accident Case Involving a Minor?

Personal injury law provides injured people the legal right to seek monetary damages they have suffered by the recklessness or negligence of another. However, there is a specific amount of time in which a claim must be brought against a negligent party and their insurance company for an accident. If the filing deadline is not met, the right to recover financial compensation may be lost due to the court dismissing the case.

California has a two-year statute of limitations on personal injury claims. This may differ in the injury case of a minor, where the statutory deadline is extended until the child turns 18 years old. They have two years from their 18th birthday to file a personal injury lawsuit if a settlement is not reached with the insurance company. Additional filing deadlines may be required in a case involving a minor, mainly if there is an uninsured/underinsured motorist claim. It is best to work with an experienced injury lawyer in these situations. Watch the video below for information on what to look for in a reputable attorney.

How Can an Attorney Help After a Pedestrian Accident?

Parents or legal guardians of minors who have been hurt by negligent drivers may be able to seek financial compensation under California law. A personal injury attorney in Brentwood who is experienced in handling pedestrian accident injury cases can help a family through this difficult time. Parents who work with lawyers who practice personal injury law exclusively can seek answers to their questions in their child’s case through a free and confidential consultation. Unlike other lawyers, injury attorneys handle pedestrian accident claims on a contingency fee arrangement, meaning no upfront payment is due. Attorneys’ fees will only be required to be paid in a pedestrian accident case if the lawyer obtains a successful outcome. By handling cases on a contingent fee basis, families can focus on their injured child’s recovery without worrying about finances or legal issues.
