Motorcycle Crash Along Scott Road Injures Biker

A motorcycle accident in Folsom occurred on April 28, which caused serious injuries to the rider. The single-vehicle crash happened around 8:27 in the morning along Scott Road just south of White Rock Road. A person who called the accident into the California Highway Patrol (CHP) said that the vehicle flew off the roadway. Officers with the Folsom Police Department arrived to assist as well as emergency responders with the Sacramento Fire Department. It was not reported which hospital the injured rider was taken to for medical care. A tow truck removed the motorcycle from the accident site. The incident is under investigation to determine what caused the motorcycle accident.

Motorcycle Accident Risk

Motorcyclists are at an obvious disadvantage when it comes to the risk of an accident. Unlike those in passenger vehicles or trucks, the safety equipment available to them is limited, and a motorcycle has two wheels instead of four, which is less stable. Motorcyclists also carry a risk of more serious injuries in a collision and an increase in the number of fatalities over those in passenger vehicles. Outside forces can come into play that can result in a motorcycle accident, where the rider may place a claim for personal injury damages. These include:

  • Passenger vehicles or trucks: Tailgating, not checking blind spots, not ceding the right of way, speeding, intoxication or distracted driving can cause a collision with a motorcycle rider.
  • Additional motorist negligence: Drivers who cut in front of the motorcyclist or who fail to properly calculate their distance from the motorcycle can precipitate an accident.
  • Debris, potholes and other road damage: When a government entity does not properly maintain streets or roads, it can lead to a motorcycle accident.
  • Poor lighting: Poor lighting can obscure road hazards, which lead to a motorcycle crash.
  • Lane splitting: Lane splitting can be done safely in California. However, motorists sharing the roadway can cause a motorcyclist to have to swerve or stop suddenly.
  • Parts defect: A defect in a tire, the brakes, fuel system and other defects are capable of causing a motorcycle crash.
  • Aggressive drivers: An aggressive driver performs actions that are potentially dangerous, including forcing another motorist or motorcyclist off the road, tailgating and cutting in and out of traffic.

Conducting an Investigation Into a Motorcycle Accident

Conducting a thorough investigation to uncover all the evidence is key to placing a successful claim for compensation. Our investigators immediately go out to the accident site to uncover the evidence required. This includes:

  • Checking the police report for mistakes
  • Taking statements from witnesses
  • Photographing the accident site and taking measurements
  • Checking for recalls on the motorcycle and complaints by consumers
  • Performing forensic reconstruction of the accident
  • Locating traffic or business cameras that might have captured the motorcycle accident on tape
  • Checking for potholes, debris or other signs of negligence by a government entity that could have contributed to the crash.

When the evidence is gathered, our experienced lawyers take over to build a strong case that supports our client’s claim for compensation. In some cases, this is used when negotiating for our client with the insurance company. However, if the insurance company balks at paying out what will cover our client’s expenses, it can be used in civil court.
