Fatality Reported in Westley Rollover Accident
A fatality was reported by the California Highway Patrol (CHP) after an SUV rollover accident on Interstate 5 near Westley, CA, on the morning of June 3, 2020. The car accident occurred on northbound I-5 near the Westley rest area shortly before 10:50 a.m. A white SUV reportedly swerved and overturned several times into the center divider, according to the CHP. An American Medical Response (AMR) ambulance and the fire department were called to the scene to assist those involved in the rollover. Sadly, at least one person was killed in the crash. Officials have withheld the identity of the decedent due to pending notification of family members.
Consequences of a Rollover Accident
We place trust in the vehicles we purchase to get us from point A to point B safely. However, motor vehicle collisions may occur in some instances outside of a driver’s control. For example, there are some cases where the car causes a crash because of a vehicle defect. SUVs have a higher center of gravities than typical passenger cars. This means there is an increased risk of rollover accidents, which can cause serious injuries or even death. The costs of medical treatment for recovering from a rollover may be more than most can afford, and there is no true value that can be placed on a lost loved one’s life. In these situations, a Modesto car accident lawyer can help injured people and families of decedents obtain the justice and compensation they need to move forward after such tragic losses.
Rollover Accidents and Roof Crush Resistance
Vehicle roof collapses are more common with SUVs and cars. In the event of a rollover, an unsteady or weak roof may not be able to withstand the impact of the collision and disintegrate as a result. In the event that you have been injured or lost a loved one in a car accident caused by a defective vehicle, you may be entitled to compensation for your injuries or loss. This may be done through filing an auto products liability claim against the automaker for unsafe vehicle design and manufacturing. Injured parties in these cases are generally entitled to compensation for medical expenses, lost wages, and pain and suffering. Families of lost loved ones may be compensated for funeral and burial expenses, lost future financial support, end of life medical care, and loss of care, protection, and guidance. Punitive damages may also be awarded by a jury for vehicle product liability cases to punish the automaker for their wrongdoing and to deter similar acts from others in the future.
To successfully recover compensation through these cases, it must be proven that the auto manufacturer failed to meet Federal Motor Vehicle Safety Standard 216 on the crushing resistance of a car roof in a rollover. This means that the vehicle in question must be kept and preserved for an experienced attorney to examine and determine whether any potential defects caused the collision.
