How Can a Wrongful Death Claim Help Survivors After a Tragic Truck Accident?

The trucking industry plays a pivotal role in the economy. However, the consequences of big rigs on the road may be severe and extensive, given their overwhelming size and weight. Those involved in a collision with a large commercial truck may suffer some of the most serious injuries on the spectrum. In some extreme cases, a loss of life may occur. When this happens to a family, they may be left in a world of pain and devastation. If the incident was the result of someone else’s negligence, survivors may take legal action against the other side in a wrongful death claim. In the case of a truck accident, a claim may be filed against multiple at-fault parties and entities, such as the trucker, trucking company, manufacturer of the big rig, and more.

California law allows the family of the decedent to file a wrongful death lawsuit within two years of the date of the fatal big rig crash. Those with grounds to do so include the surviving children, domestic partner, or spouse. The right to file may extend to other close relatives depending on the circumstances and facts of the claim. The damages available in these cases may include funeral service expenses for the decedent, costs of medical treatment for the close relative’s final injury, mental anguish experienced by survivors, and lost future income that would have been provided to the family if not for the fatal crash, and more. It can be challenging to prove the extent and value of damages incurred. Fortunately, the right Fresno wrongful death lawyer can make a difference in the outcome of a case.
