Things You Should Know About Wrongful Death Car Accident Claims

When a motor vehicle accident results in a loss of life, the at-fault party may be held liable through a wrongful death claim. This is a civil case that is intended to hold the negligent party financially accountable for the damages surviving family members have experienced because of their loss.

After a fatal car accident, it is common for a claims adjuster from the insurance company to contact a survivor for a recorded statement or to make an initial settlement offer. However, it is essential for surviving family members to keep in mind that the insurance company has no interest in offering full and fair compensation for their loss. What is unfortunate is that the role of an insurance adjuster is to protect the bottom line for the insurance company through various defense tactics.

Fortunately, a skilled Stockton wrongful death attorney is there to help surviving family members in their time of loss and grief. A lawyer will be prepared to represent the family’s best interests in litigation or negotiation against the insurance company representing the negligent party. Who is Responsible for a Fatal Rollover Collision?

In cases of fatal single-vehicle accidents, it is often presumed that they are the result of driver error. However, it is essential to keep in mind that this is not always the case. It is possible for a government entity or automaker to be liable for the incident.

In the case of government entity negligence, this may be from a road defect from a failure to maintain a public roadway or unsafe roadway design. Conversely, a car manufacturer may also be at fault for a rollover accident if the roof of the car failed to meet Federal Motor Vehicle Safety Standard 216. This standard regulates roof crush resistance in a rollover collision in terms of vehicle occupant protection from exacerbation of injury or ejection from the vehicle through the windshield or windows.
