How is Wrongful Death Proven?

While liability coverage is helpful in reimbursing surviving family members who have suffered financial hardship and intangible harm due to the unexpected loss of a close relative, there are specific elements that must be established in the wrongful death action. In most cases, eligible survivors must prove these elements to qualify for a claim for wrongful death damages:

  • The other side owed a duty of care to the deceased
  • A breach in the duty of care occurred
  • The breach in the duty of care was the proximate cause of the incident
  • Damages were suffered by surviving family members because of the fatal accident

A skilled and compassionate California wrongful death attorney can help survivors in their time of loss and grief after a fatal accident. A lawyer will be there to protect the rights and interests of surviving family members as they work toward a mutual settlement agreement with the other side or take the case to court for a jury or judge to determine a just award.

Can Surviving Family Members Seek Financial Relief After a Fatal Pedestrian Accident?

It is essential to note that specific survivors are eligible for financial relief after a fatal pedestrian crash or another type of deadly incident in California. Those with priority for filing include the children, domestic partner, or spouse. When these relationships with the deceased are non-existent, other relatives may have grounds for a case. This may include family members that were financially dependent on the decedent, such as parents, stepchildren, putative spouses, and more.
