Who is at Fault in a Vehicle Versus Pedestrian Accident Case?

It may be challenging to determine who is responsible for a fatal car vs. pedestrian accident, especially given that the pedestrian is no longer around to provide their account of the incident. Therefore, it is up to surviving family members to search for the right attorney to be their loved one’s voice by investigating the sequence of events leading up to the crash to properly determine fault. Liability may lie with one or more parties, including:

  • Driver Negligence: Motorist error causes most vehicle versus pedestrian accidents. A driver may cause a traffic collision involving a pedestrian through various acts of recklessness or negligence. This may include not yielding the right-of-way to people on foot, speeding, unsafe lane changes, not checking for pedestrians, distracted driving, and more. Under California law, a driver may be held liable for damages in a roadway crash if their negligent actions caused traumatic injuries or death to others.
  • Road Defects: The safe design and routine maintenance of public roadways fall under the scope of municipalities. Aside from the negligent driver, a government entity may be held liable for damages due to poorly designed sidewalks and roadways for pedestrian safety. It may be possible to bring a claim against a public agency. However, the process is often challenging to navigate and should be left to a skilled injury attorney to handle. Remember that these cases have a six-month deadline so do not delay.

Determining who is liable for a vehicle versus pedestrian accident requires an in-depth look at the exact cause of the incident and the resulting injuries. Negligence may lie with one or more parties based on the facts and circumstances of the matter.
