Filing a Claim for Wrongful Death Following a Fatal Pedestrian Accident

When families lose a loved one suddenly, probably the last thing they think about is filing a wrongful death claim. However, the loss can bring serious financial repercussions, especially if their loved one contributed to the family’s income. In addition, by filing a wrongful death claim, it can help bring the family a sense of closure and justice for the loss of their loved one. Some of the areas in which damages can be recovered in a wrongful death lawsuit include:

  • The cost of the funeral and burial expenses can be recovered.
  • Wages the decedent would have earned up until their age of retirement can be claimed as well as other perks of the job such as bonuses and pension benefits. If the person who died was self-employed, receipts and proof of income can be used.
  • Loss of inheritance can be recovered.
  • The surviving spouse can place a claim for loss of consortium, affection, and moral support that the decedent provided.
  • Any children in the family, including stepchildren or others who obtained at least half their support from the decedent, can claim loss of parental guidance, nurturing, and love.
