Fatal Motorcycle Crash on SR-33 in Merced County

Officers with the California Highway Patrol (CHP) reported a fatal motorcycle crash on SR-33 in Merced County on the morning of Wednesday, January 12, 2022. The traffic collision took place shortly after 8:00 a.m. on southbound State Route 33 near Marshall Road.

Details on the Fatal Motorcycle Crash on SR-33 in Merced County

CHP traffic officers revealed in a preliminary report that two parties identified as a man and a woman were riding together on a motorcycle heading southbound on Highway 33. For unknown reasons, the motorcycle was allegedly involved in a traffic collision with a GMC truck. The impact of the collision reportedly propelled the two motorcycle riders off the bike. Sadly, both parties were declared deceased at the scene.

Investigators reported that the motorcycle was lying in the roadway after the initial crash and was allegedly struck by a big rig afterward. The tractor-trailer reportedly drove away following the incident, officials said. It was also reported by authorities that it may have been possible that the semi-truck also struck both motorcycle riders. The big rig is expected to have front-end damage, and foggy conditions may have played a role in the fatal motorcycle accident, according to the CHP.

Fatal Motorcycle Accidents and Wrongful Death Cases

The loss of a family member is never easy. The grieving process for such a tragic experience may be compounded with anger and frustration when another party or entity is responsible for the loss. When a fatal motorcycle accident was the result of someone else’s negligence, it may be considered wrongful death under the law. Under these circumstances, specific surviving family members of the decedent may file a wrongful death claim against the at-fault party and their insurance company. Before such claims may be brought forward, substantial evidence must be gathered and preserved before it is lost or destroyed. This is particularly crucial if the incident involved a large commercial truck.

When a wrongful death claim involves a truck driver or a trucking company as an at-fault party, it is essential to note that letters of preservation of evidence must be sent out immediately to secure any evidence in connection with the fatal truck accident. It is not uncommon for such parties to hide or destroy evidence that is demonstrative of negligence. Retaining legal counsel is essential in such cases as an experienced accident attorney may work to ensure that all evidence is collected and preserved immediately. Without clear and compelling evidence, it may be challenging to prove a civil case and secure a successful resolution that surviving family members deserve.
