Don Julio Boulevard Intersection Site of Fatal Motorcycle Accident

A fatal motorcycle accident happened in North Highlands on July 14 after the rider was involved in a collision with a motor vehicle. The traffic accident report by the California Highway Patrol (CHP) said that the crash happened around 5:00 p.m. at the intersection of Don Julio Boulevard and Bolivar Avenue. Emergency responders with the Sacramento Fire Department arrived and attempted to perform cardiopulmonary resuscitation, however, the rider died at the scene. The CHP is performing an investigation into the cause of the accident.

Filing for Wrongful Death After a Fatal Motorcycle Accident

Because of their vulnerability, fatalities often happen when a motorcycle rider is involved in a collision. When the cause was a negligent driver or other entity, the family may wish to file a wrongful death claim to recover damages. Doing this will not ease their grief and sense of loss, of course, but it can help them avoid the added financial burden and help bring them a sense of justice.

What Happens When the Family Decides to File for Wrongful Death

The first thing the family members have to decide on is which injury attorney to use to handle their claim following their loved one’s death in a motorcycle fatality accident. We’ve successfully handled many motorcycle accident and injury claims over the years. We know all the ways insurance companies try to lay the blame on the rider and how to counter those moves, so our clients get the compensation they deserve.

Determining If the Accident Fatality Was a Wrongful Death

To place a wrongful death claim, it must be proved that another individual or entity was the cause. Our investigators are highly experienced in collecting the evidence needed. Their investigative techniques include performing accident reconstruction and searching for traffic surveillance cameras that captured the collision on tape. In addition, they interview any witnesses to the crash and check the police report for mistakes, among other areas of investigation. Once the evidence is compiled, our injury lawyers use it in constructing a strong claim.

Compiling a List of Who Can File

Members of the family who can file a wrongful death claim can include the spouse or putative spouse, which is someone who believed they were legally married but weren’t. Children in the family can join in the claim, which includes adopted children or others who received at least 50 percent of their support from the deceased.

Preparing the Claim

Documentation and the preparation of the evidence to support the claim come next. Evidence is that which was gathered by the investigators but may also include medical records, the report from the coroner, expert testimony, and accident reports. Once everything has been gathered together, your attorney can file the claim for you, which includes a list of damages they have prepared.

Because the statute of limitations for filing in California is two years, it’s a good idea to get started early. The attorney can negotiate for the family with the at-fault party’s insurance company or, if necessary, take the case to civil court.
