Hit-and-Run Pedestrian Accidents and Wrongful Death Cases

Careless drivers coupled with rural roads are a recipe for disaster. That is because reckless drivers put others on the road, including pedestrians, at risk when they do not provide the road their full attention, run stop signs or red lights, driving under the influence, speed, and engage in other careless behavior. A car vs. pedestrian accident may result in some of the most severe injuries on the spectrum because of a pedestrian’s lack of physical protection against a motor vehicle. These may include spinal cord injury, broken bones, traumatic brain injury, amputation, and death in some extreme cases. When a pedestrian crash claims a life, surviving family members may have grounds for a wrongful death claim against the driver responsible for the collision. This type of claim is generally brought against the insurance company representing the negligent driver.

There are some circumstances that may impact the recovery process for survivors, especially those cases where hit-and-run drivers are involved. This is where the assistance of an experienced Modesto wrongful death attorney may be useful. A lawyer will utilize their resources to work with a private investigator who can help track down the suspect vehicle and driver. From there, the attorney will work to determine whether the at-fault party has liability coverage to pay for the family’s economic and non-economic damages. When it has been determined that the other side has limited to no liability insurance or efforts in tracking them down were unsuccessful, an attorney may look into the family’s uninsured and underinsured motorist coverage for recourse.
