What is Wrongful Death?

In California, wrongful death occurs when an incident claims an individual’s life and is the result of someone else’s negligence or carelessness. A wrongful death case allows surviving family members to seek compensation for the intangible harm and financial losses they have suffered due to the opposing party’s negligence. While no amount of money can undo the fatal incident or bring back a close relative, it can assist survivors in avoiding financial hardship during a trying time and help them build toward a more secure future.

Seeking financial compensation in a fatal hit-and-run accident case can be challenging as identifying the suspect driver and vehicle is often difficult. This is especially true if the police are unsuccessful in locating the suspect party. An experienced attorney can help in these situations by tracking down the fleeing motorist with the assistance of a private investigator. Additionally, the right lawyer will work to identify other sources of financial recovery, like uninsured motorist coverage, which may pay for losses resulting from a hit-and-run accident.

Surviving family members have two years to file a wrongful death case in California. The two-year statute of limitations starts on the date of the fatal incident. If survivors miss the deadline, they may lose the right to seek compensation from the opposing party. It is essential for a family to act quickly and retain legal counsel. An experienced attorney can handle all aspects of the case while allowing the family the time needed to grieve. The right lawyer will have experience handling fatal accident cases, conducting in-depth investigations, and negotiating with difficult insurers and defense counsel.
