How Can a Wrongful Death Claim Help Surviving Family Members?

The loss of a loved one is heartbreaking and devastating. The loss may be even more painful when it could have been prevented and was the result of another party or entity’s negligence. When this is the case, eligible surviving family members may be able to take legal action against the at-fault party through a wrongful death claim. While nothing may undo the tragic loss a family has endured, compensation from these cases may help cover costs of end-of-life medical treatment, funeral service expenses, lost future financial support, and more. Punitive damages may be available in cases involving egregious conduct like speeding excessively and DUI. These are awarded in some rare cases and serve the sole purpose of punishing the negligent party.

Under California law, a wrongful death lawsuit may be brought by the surviving spouse, domestic partner, or children of the deceased. Others may be eligible for filing, as outlined in the California Code of Civil Procedure Section 377.60. Since there are various filing criteria and deadlines involved in such cases, it is essential to let an experienced Sonora personal injury lawyer review the facts and circumstances surrounding the incident and determine the best course of action for surviving family members moving forward. Keep in mind that the insurance company, including your own, will not always be fair when it comes to financial compensation. That is why it is essential to have legal counsel looking out for your interests and protecting your rights.
