What is a Wrongful Death Claim?

A wrongful death action provides surviving family members with the opportunity to seek reimbursement for economic and non-economic damages. It also provides survivors a sense of justice and closure by holding at-fault parties accountable for their loss. Eligible surviving family members may be compensated for medical bills (this is recoverable via survival action), funeral service expenses, loss of companionship, mental anguish, loss of financial support, and more.

In California, there is a two-year time limit on cases for wrongful death. This means that surviving family members have up to two years from the date of a close relative’s demise to file a lawsuit in court against the negligent party. When an eligible survivor fails to do so, they will lose the right to bring a claim for wrongful death and seek reimbursement for damages incurred. Therefore, time is of the essence in fatal accident claims.

The insurance company representing the driver responsible for the incident may resort to defense tactics in a wrongful death claim. While not uncommon, surviving family members may be unsure of how to proceed in their situation when dealing with difficult insurers and disputes regarding liability and the resulting losses. Under these circumstances, it is useful to retain legal counsel that is committed to providing representation to clients through experience, compassion, and support.
