Losing a Loved One in an Accident

There is no denying that the loss of a loved one may be the most trying and challenging time of surviving family members’ lives. It may leave survivors in a state of deep grief that may be compounded by confusion, anger, and frustration when it has been discovered that the loss was the result of someone else’s negligence. When negligent or reckless conduct occurs that causes a loss of life, it may be considered wrongful death under California law. Under such circumstances, surviving family members may seek financial recovery of economic and non-economic damages associated with the loss of a close relative.

The unexpected loss of a loved one is devastating and may result in an immense amount of sadness and heartbreak, among other consequences. These include:

  • Mental Anguish: When there is a sudden loss in the family, it may impact them emotionally. This is why surviving family members may be compensated for the mental anguish and emotional trauma they all have experienced because of the wrongful death car accident.
  • Financial Challenges: When a family loses a primary provider, they should be compensated for the loss of future financial support and lost benefits, including health insurance coverage and pension. It is likely that the decedent would have continued to work until they reached the age of retirement. Therefore, the family may seek compensation for anticipated wages.
  • Losses in the Relationship: When a close relative is taken away from a family suddenly, survivors may often suffer from loss of comfort, companionship, care, guidance, protection, and support. California law recognizes this and allows survivors to bring a wrongful death case to seek recovery of these non-economic damages.

Why it is Important to Work with an Attorney

Families who have suffered the unexpected loss of a close relative should discuss their case with an experienced attorney as soon as possible. The reason is that insurance carriers representing negligent drivers and entities want to pay as little as possible on claims, even wrongful death cases, when liability is clear. That is why it is essential to work with a lawyer to ensure you receive justice and fair compensation for your loss.

Keep in mind that there is a two-year statute of limitations that applies to such cases in California. If a lawsuit is not filed within that window of time, survivors may lose the right to bring the case forward. The sooner you retain an attorney, the sooner your lawyer can get to work on your case to obtain the best outcome possible on your behalf.
