Details on the Fatal Crash Reported on Greger Street in Oakdale

A preliminary report by CHP traffic officers revealed that a 29-year-old man was driving the Ford westbound along Greger Road. For unknown reasons, the Ford driver reportedly lost control of the vehicle after approaching a curve and colliding with a raised curb. After striking the curb, the Ford continued for a short time before crashing into a tree and then a home located just east of Wild Stallion Drive.

The Modesto Fire Department reported that no one in the residence suffered injuries from the incident. Sadly, the driver and passenger of the Ford were both declared deceased at the scene of the car crash. The Stanislaus County Coroner’s Office has recently identified the deceased driver as 29-year-old Jorge Galan of Oakdale and the deceased passenger as 27-year-old Martin Gonzalez of Oakdale. The exact cause of the fatal car accident and the sequence of events leading up to it have not yet been released by CHP due to an ongoing investigation.

What You Should Know About the Wrongful Death Claims Process

The sudden loss of a close relative is challenging to come to terms with, especially when it was the result of someone else’s reckless or negligent actions. Surviving family members may be overwhelmed with loss and grief all while being impacted by financial hardship following the incident. Families faced with such situations may be able to take legal action against the at-fault party through a wrongful death claim. Such cases are generally brought against insurers to seek economic and non-economic damages like funeral and medical bills, lost future financial support, loss of companionship, mental anguish, and more.

In California, a wrongful death case may be brought by the surviving spouse, domestic partner, or children of the deceased. Other family members may be eligible for filing, as outlined in the California Code of Civil Procedure Section 377.60. These cases must be filed within two years of the date of loss under CCP 335.1. If a lawsuit is not filed within the time limit, nor is an insurance settlement accepted, the family may lose the right to recovery of compensatory damages.

It may be challenging for a grieving family to keep track of filing criteria and deadlines in their case. An experienced Oakdale wrongful death lawyer may help surviving family members by handling all aspects of their case. When a family retains legal counsel, they can depend on their lawyer to negotiate a full and fair settlement with the insurer or take the case to court if the insurance company is unwilling to make a satisfactory offer.
