What is Included in a Wrongful Death Claim for a Car Accident?

When a loved one loses their life in a car accident in Modesto, the loss may impact surviving family members in a wide array of ways. A wrongful death claim may be an opportunity for a family to be made whole again for the financial and intangible harms they have experienced because of someone else’s negligence. While a beloved close relative may never be brought back and the pain cannot be undone, survivors may at least be compensated for their loss. Compensation through these cases is categorized into economic and non-economic damages, both of which may include recovery for:

  • Costs of accident-related treatment (this is generally sought through a survival action)
  • Final resting expenses for the decedent
  • Loss of care, companionship, and protection from the deceased
  • Lost future financial support the loved one would have provided if not for the wrongful death car accident

The void that survivors experience when they lose the guidance and support the decedent provided
A wrongful death claim for a motor vehicle collision generally involves the calculation of damages and testimony from expert witnesses. The assistance of a skilled accident attorney is often necessary to guide surviving family members through the process. That is because the at-fault party and the insurance company may have defense counsel given the stakes of the fatal car accident case since the losses may be substantial. Therefore, it is best to bring such cases with the assistance of an experienced Modesto wrongful death lawyer. Is There a Time Limit on Wrongful Death Claims in California?

There is a statute of limitations that surviving family members must abide by when considering bringing a wrongful death lawsuit against the party responsible for their loss. Under the California Code of Civil Procedure Section 335.1, a lawsuit must be filed no later than two years after the fatal accident date in civil court. After the deadline has passed, the family may lose the right to initiate a civil action. When survivors are already grieving a loss, they may be overwhelmed by the thought of bringing a case. That is where an experienced accident attorney may come in.
