What is Involved in the Wrongful Death Claims Process?

The loss of a family member may create a ripple effect leading to other damage in the lives of surviving family members. While the value of a claim for wrongful death may vary based on the facts involved, survivors may typically seek reimbursement for non-economic and economic damages. These may include lost financial support and income from the decedent, loss of services, funeral costs, mental anguish, loss of companionship, and more. While unique circumstances exist in each case of wrongful death, the process generally follows specific procedures and rules.

A claim for wrongful death is based on the personal relationship of the surviving family member to the decedent. In California, the surviving children, spouse, or domestic partner have priority for filing a case. Exceptions may apply if these relationships with the deceased do not exist. The California Code of Civil Procedure Section 377.60 outlines this in detail. Moreover, survivors have a maximum of two years for filing. This means that surviving family members must settle the case within the two-year deadline or file the case before the statute of limitations runs out.

While there are exceptions that may change this deadline, a thorough analysis of the case by an experienced wrongful death attorney is necessary to determine if any apply. If surviving family members wait too long to file the case in civil court, and a settlement is not reached with the other side within that time limit, they may lose the right to seek damages for the tragic loss that they have endured. During this time of hardship, a California wrongful death attorney can be an invaluable source. Do not wait and retain legal counsel right away.
