A release by CHP traffic officers revealed that a 2014 Scion XB was traveling northbound on McClure Road. What Types of Losses Can Be Recovered in an Accident Case?

When an individual sustains injuries in a traffic collision, they may bring a claim for damages against the individual or entity that caused the crash. Eligible claimants may seek the recovery of financial losses like lost earnings, diminished earning potential, past and future costs of treatment for accident-related injuries, out-of-pocket expenses, etc. An injured party may also be entitled to compensation for mental anguish, loss of quality of life, loss of consortium, and other intangible harm associated with the incident itself and the associated injuries.

For surviving family members who have been deprived of a loved one due to a traffic crash, eligible claimants may be compensated for losses associated with the unexpected death. This may include funeral costs, loss of financial support from the deceased, medical treatment expenses (from a survival action), loss of companionship, and other related losses. Strict deadlines apply to wrongful death cases. A two-year time limit applies to these matters. The same two-year statute of limitations also applies to cases of personal injury.

Who Can Be Held Liable for a Truck Accident?

Various parties may be held accountable for damages from a big rig crash. This may include the truck driver, trucking company, cargo shipping and loading companies, manufacturers of big rigs and truck parts, and more. It is essential to have an attorney conduct an in-depth investigation into a commercial truck accident case, including those involving parked big rigs. A lawyer will work to gather and preserve evidence, determine that the truck was parked legally at the time of the incident, and build a strong and compelling case to present in insurance negotiations or in the courtroom if necessary.
