Eligibility to File a Lawsuit for Wrongful Death

The immediate family members of a deceased person may file a wrongful death claim. The decedent’s spouse and children, who received at least half of their financial support from the deceased, would be included in this group. Likewise, an estate administrator can do so. Only one claim is allowed, so it must be decided which one will file. The parents and siblings of the deceased can file a claim if there is no child or spouse.

Wrongful Death Compensation

When a loved one is killed in a fatal intersection crash, financial compensation can’t compensate for the loss. Nevertheless, they would probably not want to put their family under financial stress. The following damages are often available to those who file wrongful death lawsuits:

  • The decedent’s death in a fatal collision near Eureka would likely have resulted in the family losing income and benefits, including insurance and retirement coverage. In this case, the deceased’s income and coverage may be recovered until retirement.
  • It is possible to recover funeral and burial expenses.
  • The deceased’s family can recover the costs associated with the services they usually provide around the home.
  • Recovery of inheritance loss is possible in some cases.
  • There can also be compensation for the loss of emotional support and affection provided by the deceased.
