Things Surviving Family Members Should Know About Cases of Wrongful Death

According to California law, a claim for wrongful death may arise when a party’s negligence causes a loss of life. It may be accidental, such as a vehicle versus motorcycle crash. Whatever the manner of a family member’s demise, if survivors believe that the fatal incident occurred as a result of another party’s negligence, they may have grounds for a claim for damages under California law. The claim itself must be brought by relatives who have priority. This includes the spouse, domestic partner, or children, according to CCP 377.60. Under specific circumstances, other relatives may be eligible for filing.

Surviving family members may bring two types of cases, including a survival action and a wrongful death claim. Both cases focus on compensating survivors for intangible harm and financial losses. However, one considers what losses were incurred before the deceased’s passing, and the other considers what losses occurred after their death. A survival action may seek reimbursement for end-of-life treatment, lost wages, etc. In a wrongful death action, surviving family members may seek reimbursement for mental anguish, loss of companionship, lost future financial support, funeral costs, and more.

Coping with grief and navigating the legal process may be challenging even in ideal circumstances.
