Things to Know About the Wrongful Death Claims Process

The loss of a close relative because of a motor vehicle crash is a devastating and painful situation. Surviving family members are often left behind to pick up the pieces while coping with grief from the unexpected event. The financial stress of such an ordeal may be alleviated by bringing a wrongful death claim against the party responsible for the incident. This type of case may help survivors seek justice and financial compensation for losses they have experienced in connection with their loss. This may include lost companionship, loss of future financial support, mental anguish, medical costs for final injuries, funeral service expenses, and more.

California imposes a two-year statute of limitations for fatal accident cases. This means that a family has up to two years to file a wrongful death lawsuit in court, or the court will dismiss the case. Remember that substantial time and research are necessary for the preparation of these cases to present in insurance negotiations or in the courtroom. Therefore, it is crucial for survivors who are considering bringing a case to consult with an experienced accident attorney.

Under California, only certain relatives are eligible to bring a wrongful death case. This includes the surviving spouse, domestic partner, or children of the deceased individual. Other family members may be eligible to bring a case if such relationships are non-existent. This may include the decedent’s parents, putative spouse, and stepchildren. To determine your eligibility, reach out to an experienced Fresno wrongful death attorney. For information on how to select the best lawyer, watch the video below.
