Types of Recoverable Losses in an Accident Case

When another individual or entity causes a motor vehicle collision through negligence or carelessness, then the injured party or surviving family member of the decedent may seek compensation for their losses. These are broken down into non-economic and economic damages. An injured individual may seek reimbursement for pain and suffering, wage loss, medical bills, etc. Surviving family members may be compensated for mental anguish, loss of financial support from the deceased, funeral service costs, and other losses experienced due to the wrongful death of a loved one.

Claims for Damages From Motor Vehicle Collisions

When a family member suffers fatal injuries in a motor vehicle crash because of someone else’s carelessness or negligence, it may be devastating for the entire family. This is unfair to bereaved families that are often forced to pick up the pieces and move forward with a life without that loved one. California law recognizes the immense harm that may occur from the loss of a close relative in an accident and provides surviving family members the opportunity to hold the at-fault party accountable in a wrongful death action.
