Determination Being Made in Fatal Car Accident

Cardiopulmonary resuscitation was performed on one person, but they could not be saved. Both lanes were blocked by the crash, and all three vehicles had to be towed. Traffic was diverted at Road 200 while the scene was cleared. The name of the deceased will be released by the county coroner once the family has been notified. The CHP traffic crash unit is handling the investigation into the cause of the crash.

Compensation Recovery Following a Wrongful Death

Negligence in a fatal car accident leading to a wrongful death claim requires proving fault in an accident that causes a pedestrian’s death. Your injury attorney will conduct an investigation to collect evidence supporting your family’s damage recovery claim. This process involves examining police reports, interviewing witnesses, obtaining surveillance footage, and employing other investigative methods. Using the evidence that was collected, your injury lawyer will build a strong case and negotiate with the negligent party’s insurance company or present in court.

Securing Compensation for a Wrongful Death

Generally, the spouse and children of the deceased file a wrongful death claim after a fatal car accident. The proceeds from the settlement are divided. If the decedent was never married and had no children, their siblings and parents may file. In other cases, the administrator of the decedent’s will can file. However, only one claim is allowed.

When a family pursues a wrongful death claim following a loved one’s death in an accident on the interstate due to someone else’s negligence, they may be eligible to recover compensation for:

  • Funeral and burial costs can be recovered by the family.
  • Wages the deceased would have earned until their expected retirement is recouped. Wages include compensation for the decedent’s pension and insurance benefits, tips, bonuses and other perks that came with the job
  • Losses experienced by the spouse and children include the loss of consortium, love and moral support for the decedent’s mate. Children recover compensation for their loss of guidance, moral support, and nurturing.
  • Compensation for the household tasks the deceased performed is given to the family for the need to hire others for these duties. Some examples of household tasks include cleaning, cooking, childcare, tax preparation, lawn and auto care.
