What to Expect from a Wrongful Death Claim for a Truck Accident

Surviving family members may be reluctant when it comes to bringing a wrongful death case. Whether the process may seem daunting to them or they are overwhelmed with grief, it is essential to understand that time is of the essence in these situations. That is because a two-year statute of limitations usually applies to wrongful death claims. Bringing this type of case against a negligent truck driver or trucking company may help provide survivors with the sense of justice they need. Conversely, financial recovery may also provide for a more secure future.

Examples of economic and non-economic damages recoverable in such cases may include expenses for a funeral and burial, lost companionship, medical bills for the final injury sustained in the big rig crash, loss of future financial support, and more. As one may imagine, determining the value of economic and non-economic damages in a wrongful death truck accident case may be challenging. It is often necessary to work with expert witnesses such as an economist to prove the reasonable and necessary value of damages. Economists have specialized training that helps provide insight into the full scope of a family’s financial losses.

When liability is disputed in a big rig crash case, it is also useful to work with an expert in the field, such as an accident reconstruction expert, who can use their specialized training to determine the sequence of events leading up to the incident to properly determine fault. Surviving family members can also depend on their Fresno wrongful death lawyer to gather and preserve evidence before it is lost or destroyed over time. This is essential in truck accident cases, given that a letter of preservation of evidence must be sent immediately to the other side. Fortunately, an experienced accident attorney can help with that and other aspects of a claim. For information on how to choose the best lawyer to represent your family, watch this video.
