Things to Know About Big Rig Crash Cases in California

For injured parties and families of decedents, a commercial truck accident may be a particularly devastating event since it could have been prevented if the trucker, trucking company, or other party had exercised due care. Along with the pain and grief that injured parties and surviving family members must deal with, they may also find themselves in financial hardship because of the big rig crash. Those facing such situations need information about their rights after a tractor-trailer collision and how to proceed with a claim for damages against negligent parties.

There are important laws that must be followed in personal injury and wrongful death cases. One of which includes the statute of limitations or deadlines for cases. In California, there is a two-year statute of limitations for wrongful death and personal injury cases. This means that an injured party or a surviving family member has no more than two years from the date of the incident to file the case in court. This serves to protect the statute. If a claimant fails to do so, they may lose the right to seek damages from the other side for the accident.

There are a unique set of circumstances involved in each commercial truck accident case. This means that each claim and settlement amount will vary based on the facts of the matter. Expertise and experience matter when it comes to hiring a California personal injury lawyer for a big rig crash.
