Details on the Fatal Accident on Del Puerto Canyon Road

A preliminary release by authorities indicated that the Chrysler allegedly veered off the roadway and traveled down a steep cliff. The vehicle reportedly overturned and came to a rest in a shallow creek, the CHP reported.

Sadly, the driver and passenger both suffered fatal injuries in the solo car crash. Officials have recently identified the decedents as 24-year-old Lee Her and 27-year-old Wee Vang, both Stockton residents. Separate GoFundMe pages have been set up for the families of Lee Her and Wee Vang to assist with final resting costs.

An investigation is ongoing by officials, and no further details are available.

What is Wrongful Death?

Wrongful death refers to an incident that results in a loss of life and is caused by the negligence or carelessness of another party. California law recognizes the financial and intangible losses that may occur from a loved one’s wrongful death. As such, eligible surviving family members may have grounds for a claim for damages against the negligent party. Family members must file a wrongful death action no later than two years from the date of the fatal incident. If a family fails to do so before the statute of limitations runs out, they may lose the opportunity to take legal action and recover compensation.

Compensation in a wrongful death case generally falls into two categories, including economic and non-economic damages. These may include lost income, support, and services the decedent would have provided to the family household had they survived, costs of a funeral and burial, loss of a loved one’s guidance, protection, companionship, and care, mental anguish, and more. Specific family members are entitled to obtain damages in these cases. To determine your eligibility, contact an experienced wrongful death attorney near you.
