Falling Objects Can Cause Serious Injuries or Death

I’m Ed Smith, a Sacramento Falling Objects Lawyer. Each year, my firm is asked to represent clients (or their loved ones) after someone suffers serious pain or even death due to a heavy falling object. In some cases, we’re hired by the survivors of individuals who died after large, falling objects ended their lives.

Negligence

If negligence by one or more parties played a key role in the accident, then you may be able to recover beyond what’s available through worker’s compensation. We also accept cases after a person has visited a construction site – or gone shopping in a large warehouse store like Lowes, Costco or Home Depot – and has been severely injured by a falling product or object that slipped off a high shelf.

Injuries From Falling Objects

People hurt in these ways can suffer serious head and brain injuries, broken bones, severe lacerations, and even death. Regardless of the exact way you were harmed by a falling object, you may want to contact our office right away. We’ll review the facts of your case to see if you have a legal right to pursue additional compensation for your medical bills, lost earnings, and pain and suffering.

California Cases Involving Falling Objects

During the year 2015, far too many construction workers suffered serious injuries due to falling objects. In July, a Yolo County construction site employee, helping others handle a municipal water project, was working below ground in a cofferdam (a dry, watertight space created to help employees do work below a waterline) when he was hit by an object. Fortunately, rescuers quickly reached him and sent him to UC Davis Medical Center. He was later reported to be in stable condition.

Later that year, another man working in construction lost his life at a FedEx distribution center in Oceanside. The accident happened while a male in his fifties was helping others work on a rainwater drainage system. The men thought they had already properly positioned a concrete “headwall” in the ditch so it would help funnel rainwater into drains to minimize property erosion. Sadly, the headwall became dislodged and fell upon this man. It measured approximately three feet by five feet – and was about one foot thick. Although the man’s co-workers quickly sprang to action and obtained a crane to help them lift the headwall off his body, he still died at the scene.

Accidents like these rarely happen without some party’s negligence.

Parties in Charge of Work Sites & Stores with Highly Stacked Objects Owe a Duty

Owners of construction sites and large stores that keep many goods stacked high above the aisles owe everyone a duty to keep the areas safe and free from unreasonable dangers. When that duty is breached, you can often successfully sue those parties for negligence. Your Sacramento personal injury attorney can explain how this works in greater detail.

We hope you’ll contact our office right away so we can help you evaluate your case to determine if a lawsuit should be filed on your behalf.
