Fairfield Motorcyclist Killed

I’m Ed Smith, a Fairfield motorcycle accident attorney. On July 3, 2017, a hit-and-run motor vehicle accident on Highway Interstate 80 in San Pablo fatally injured a man from Fairfield.

Accident Details

According to reports issued by the California Highway Patrol (CHP), the collision took place at 6:22 a.m. on the westbound section of Interstate 80. CHP indicated that Nicholas Brown, a 35-year-old resident of Fairfield, had been riding his motorcycle on the highway when a big-rig truck made an unsafe lane-changing maneuver and struck Brown’s motorcycle.

CHP Officer Matthew Hamer noted that Brown was forced to veer out of his lane as a result of the collision and collided with another vehicle before he was thrown off of his motorcycle and into the roadway.

Hit-and-Run

Witnesses of the collision told CHP that, after the accident, the truck pulled over for a few minutes before eventually driving away from the scene, leaving the injured man in the middle of the highway. Witnesses also indicated to CHP that the big rig’s cab was yellow and that it had been hauling a white trailer.

Later in the day, officers pulled over a big-rig that matched witnesses’ descriptions, but do not believe that the truck was the same one that collided with Brown’s motorcycle.

Hit-and-Run Accidents

Hit-and-run collisions have been becoming more frequent in the U.S. for over a decade. Additionally, they are often very difficult to deal with because the path forward for injured parties is not clear.

Firstly, if you are hurt in a hit-and-run collision, California law requires that you report your accident to the Department of Motor Vehicles if any parties died or sustained injuries, or if property damage exceeded $750.

However, reporting a hit-and-run accident isn’t only beneficial because it keeps you in compliance with the law; it is critical in tracking down the motorist who fled the scene of the collision.  Typically, the sooner that a hit-and-run accident is reported, the more likely it is that officers will be able to find the missing driver.

Another key factor to consider in cases involving hit-and-run accidents is receiving medical attention. Many who are injured in hit-and-run collisions are hesitant to go to the hospital because they are unsure of how they will be able to pay for their treatment since the other driver is not there to take responsibility. 

Those who find themselves in this situation should always accept the medical attention they need. Making sure that you get the treatment you need is important and can also be critical later on when filing a claim. Those who do not seek medical attention leave room for insurance adjusters and courts to doubt the seriousness of their injuries and reduce the value of their claims.
