Driver Loses Control at Red Top Road and Suffers Injury Accident

One person was hospitalized on August 12 in an injury accident that occurred in Fairfield. The Fairfield Fire Department reported that the accident happened late at night, close to the Red Top Road intersection with Lopes Road. The vehicle reportedly went off the road and struck a pole, causing significant front-end damage and a shattered windshield. 

Investigation Underway to Determine Injury Accident Cause

One person suffered injuries in the accident and was transported to a nearby hospital for medical treatment and evaluation. An investigation is underway by authorities to determine what happened to cause the accident. No additional information was provided on the extent of injuries to the driver.

How an Outside Influence Can Cause a Single-Vehicle Accident

Most of the time, an accident involving a single vehicle happens because the driver was negligent. For example, speeding, talking on a cell phone, and other errors can lead to a crash. However, in some cases, an outside influence can lead to an accident that injures the driver and/or passengers. When this happens, the injured parties can file a compensation claim. By filing a claim, they can recover their medical expenses, compensation for pain and suffering, lost wages and more. 

Defective Auto Parts Can Lead to a Collision

In some instances, a defective part in an automobile can lead to an accident. Airbags that are defective and deploy when they shouldn’t, brakes that fail or accelerators that stick are examples. The vehicle, of course, should be retained following a collision where a defective auto part is expected. This allows an engineer to examine the vehicle to check for defects. When it has been determined that a defective part led to the injury accident, the injured party can place an auto product liability claim against the manufacturers and others in the production line to recover damages.

Government Negligence

Government agencies are in charge of keeping the roads safe in various ways. For instance, they are required to fix potholes and keep signs readable to drivers. If an injury accident happens because of their failure to do their job, you can file a lawsuit against them. 

There are differences between this type of claim and others. A critical issue is adhering to the deadline. Unlike personal injury lawsuits, the statute of limitation is not two years. Initially, you have six months to file an administrative claim with the government agency, city or state in California. After filing, the government has 45 days to answer. If they agree with your claim, negotiations begin. If they do not answer at all, you have two years to file a lawsuit. On the other hand, if your claim is denied, you have six months to file a lawsuit.
